| 1. | NO PURCHASE NECESSARYTO ENTER: You must be 18 years of age or older and a legal resident of the United States or Canada. Contest begins on May 27, 2005, and ends on May 28, 2005. You can enter by being present at the New Buffalo Welcome Center on May 27, 2005 from 9am-5pm. One individual package will be awarded to one prize winner per each Beachtown partner for a total of 9. Duplicate entries will be removed. The winner will be randomly chosen on May 29, 2005. |
| 2. | WINNERS: The contest will have one (9) winners chosen in a random drawing from eligible entries received. Odds of winning depend on number of eligible entries received. Entrants agree that Michigan’s Beachtowns has the sole right to decide all matters and disputes related to the contest and that Michigan’s Beachtowns determination is final and binding. Winners agrees to allow use of their name, photograph, voice and likeness in any medium of communication, including print, Internet, radio and/or television for advertising, promotional or other purposes by Michigan’s Beachtowns and/or its affiliates or sponsors, without additional compensation. Winners assume all applicable tax liability for the contest prizes. Winners must claim prize within 14 days of notification; failure to do so will result in forfeiture of prize. |
| 3. | PRIZES: Prizes are non-transferable, non-negotiable and not redeemable for cash. Nine (9) winners will receive a getaway for one of the nine Beachtown communities located along Lake Michigan. Each community has prepared a getaway for this contest. The details of the getaway will be provided once your name has been selected. Prize package will be valid through dates established with in your winning package. Approximate retail value of each package is $500.00. Winners are responsible for all travel and incidental charges, including telephone calls, valet service, gratuities, merchandise, room service and all applicable taxes. If any prize becomes unavailable, the representative Beachtown community reserves the right to substitute a prize of comparable value. |
| 4. | ELIGIBILITY: This contest is not open to employees of Michigan’s Beachtowns, Travel Michigan, Michigan Economic Development Corporation and providers of giveaway packages, their immediate family, or to employees or immediate family of any Michigan’s Beachtown, Travel Michigan, Michigan Economic Development Corporation and providers of giveaway packages, parent, subsidiary or affiliated company, licensee, advertising or promotional agency, or sponsor. Void where prohibited or restricted. Michigan’s Beachtowns reserves the right to reject entries from countries, states and jurisdictions where this contest is prohibited. |
| 5. | GENERAL TERMS AND CONDITIONS: By participating, entrants agree that the Sponsor, its agents and representatives, affiliates, subsidiaries and legal advisors are not responsible or liable for, and shall be released and held harmless from: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted; (iii) any printing or typographical errors in any materials associated with the Contest; (iv) any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Contest, acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Sponsor reserves the right, in its sole discretion, to suspend or cancel Contest at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Contest. By entering in to the contest, entrants grant permission to allow the Sponsor to share submitted information with tourism-related businesses that the Sponsor selects. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with contest, shall be governed by, and construed in accordance with the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Michigan or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Michigan. |
